01. Background

On the day of the incident, the Client (the Suspect) joined a table at a bar with a woman (the Complainant) whom he had met for the first time that day and a third party (the Witness), and they drank together. Thereafter, at the Complainant’s suggestion, they moved to a karaoke establishment near the bar, where the Client had sexual intercourse with the Complainant inside a private room. However, several days later, the Complainant reported the Client to the police, alleging that he had forcibly grabbed her wrist, removed her clothing, and raped her while the Witness was away from the room. The Client, asserting that he had been falsely accused, visited MEGA X Law Firm.

02. Key Issues

01
Whether the exercise of force or threats, or other acts of coercion, occurred during sexual intercourse
02
Whether the sexual intercourse was consensual
03
Challenge to the credibility of the victim’s statement

03. Legal Strategy

\"The MEGA X defense team responded by meticulously analyzing the Suspect’s specific recollections and circumstantial evidence from before and after the incident in order to overcome the unfavorable circumstance that there was no CCTV footage inside the private room.

1. Request to Secure CCTV Footage at the Initial Stage of the Investigation:

Although there was no CCTV camera inside the karaoke room, we promptly requested that the investigative authorities secure CCTV footage of the hallway and the circumstances surrounding the parties’ entry into and exit from the building before the relevant evidence was deleted. This enabled us to establish through objective video evidence the Complainant’s voluntary movements immediately before and after the sexual intercourse and her calm demeanor at the time.

2. Organizing Prior Statements and Accompanying the Suspect During Questioning:

Before attending the police interview, we carefully organized the circumstances and conversations from the day of the incident in chronological order. Thereafter, an attorney accompanied the Suspect during the police interview and assisted him in providing consistent and specific statements without becoming flustered, based on his prior preparation.

3. Establishing Contradictions in the Complainant’s Statements and Submitting Counsel’s Written Opinion:

By comparing the timeline of the secured CCTV footage with the period during which the Witness was absent (approximately 3–5 minutes), we clearly pointed out that the sequence of events alleged by the Complainant was temporally and physically impossible. In addition, we submitted counsel’s written opinion, which analyzed the circumstantial evidence—including the Complainant’s conduct immediately after the incident—from a legal perspective, thereby undermining the credibility of the Complainant’s statements.\"

04. Outcome

No Suspicion of Criminality
