MEGA X did not view this matter merely as an incident involving a disturbance, but organized the facts around the elements that must be established for the crime of interference with business to be found. We examined whether there had in fact been interference with business by comprehensively reviewing the circumstances under which the client came to use the business premises, the client’s condition at the time the client was asked to leave, and the developments following the report.

In particular, we focused on the fact that the existence of a disturbance and the determination that criminal interference with business has been established must be distinguished. Accordingly, we organized the issues around whether the circumstances at the time constituted the type of coercive force sufficient to suppress the other party’s business and whether they were sufficiently serious to be deemed actual interference with business.
