03. Legal Strategy

MEGA X first reviewed the materials concerning the disciplinary action and the internal procedural materials to organize the analytical framework for each ground for discipline.

In particular, MEGA X distinguished between the statements at issue and the course of the proceedings, and examined whether the relevant circumstances were sufficiently serious to warrant substantial disciplinary liability.

With respect to the allegation that the client had an improper intent, MEGA X also considered the overall course of the proceedings together with the final outcome. Based on this review, MEGA X explained that, notwithstanding certain deficiencies in the conduct of the proceedings, it would be difficult to conclude that the matter had been intentionally understated or that a particular outcome had been induced.

Regarding the appropriateness of the sanction, MEGA X focused on whether the severity of the original disposition was proportionate to the client’s actual degree of responsibility. MEGA X submitted that the three-month salary reduction was excessive, taking into account the nature of the conduct at issue, the client’s role in the proceedings, and the various circumstances before and after the disciplinary action.
