03. Legal Strategy
MEGA X structured this matter not as a case involving the client’s direct operation of a vehicle while intoxicated, but as one requiring an examination of whether the provision of the vehicle and the circumstances of accompanying the other person could be deemed aiding and abetting. First, based on the contents reflected in the investigation records and judgment, we rearranged chronologically the time the vehicle was provided, the client’s awareness of the other person’s intoxicated condition, the process by which the actual driving began, and the circumstances under which the client boarded the vehicle. Through this process, we distinguished and explained the client’s mere presence from conduct that could be connected to a determination of aiding and abetting.
We also organized the analysis separately so that the elements for establishing aiding and abetting would not be conflated with sentencing considerations. Specifically, we distinguished the issues concerning why handing over the vehicle in a condition in which it could be driven might be problematic from the reasons why the circumstances leading to the incident, the client’s status as a first-time offender, and the admission of the offense could be reflected in the manner of sentencing. In this matter, rather than emphasizing only that the client did not drive directly, it was important to respond by separately explaining what conduct served as the basis for determining aiding and abetting and the circumstances in which that conduct occurred.
