01. Background

The client was employed as a public official and became subject to allegations of indecent assault arising from physical contact that occurred during a private occasion with an individual with whom the client had a workplace relationship. The client had to respond to criminal proceedings concerning the physical contact itself while also addressing concerns regarding disciplinary action, personnel-related disadvantages, and workplace reputation resulting from the client’s status as a public official.

Unlike ordinary criminal cases, cases involving indecent assault by a public official require a more careful response because the outcome of the investigation may immediately lead to consequences affecting the individual’s official status. Beyond merely participating in the investigation, it is necessary to strategically formulate, from an early stage, the direction of the client’s statements, the review of objective evidence, the possibility of settlement, and the materials to be submitted to the prosecution. This can make a meaningful difference in the ultimate outcome.

02. Key Issues

01
The Relationship at the Time of the Incident and the Surrounding Circumstances Before and Afterward
02
The Consistency Between Objective Evidence and the Parties’ Statements
03
Restoration of the Victim’s Harm and Whether a Settlement Was Reached
04
Whether the Client Was a First-Time Offender, Efforts to Prevent Recidivism, and Remorse
05
Additional Disadvantages Resulting from the Client’s Status as a Public Official

03. Legal Strategy

MEGA X first carefully reviewed the client’s statements and objective evidence, distinguished the matters to be acknowledged from those to be contested, and organized the structure of the case. Because an unstable initial response in a sexual offense case can adversely affect the overall assessment of the case, we assisted the client in avoiding emotional explanations or unnecessary elaboration and in maintaining a consistent approach to the client’s statements.

At the same time, we proceeded carefully with measures to restore the victim’s harm. In a case involving indecent assault by a public official, a settlement is a highly significant factor, but merely making a formal attempt to settle is insufficient. It is important to coordinate the apology and communication of the client’s intentions in a manner that does not aggravate the relationship with the victim, and to obtain settlement documents and a statement expressing the victim’s desire not to seek punishment that the prosecution can meaningfully consider.

MEGA X also addressed the disadvantages arising from the client’s status as a public official. We systematically organized and submitted to the prosecution materials regarding the client’s status as a first-time offender, history of conscientious participation in society, profound remorse, efforts to prevent recidivism, and intention not to approach or contact the victim any further.

Ultimately, the core of this case was not simply an appeal for leniency.

Given the nature of a case involving indecent assault by a public official, strategic assistance that took into account both the criminal defense and the risk of disciplinary action was necessary. MEGA X structured the case with this consideration at its center.
