03. Legal Strategy
MEGA X first carefully reviewed the case records and then organized, for each victim, the amount of loss, whether restitution had been made, the possibility of reaching a settlement, and the necessity of making a court deposit. In fraud cases involving numerous victims, it is important to present the overall status of recovery in a structured manner. Accordingly, we developed and implemented a tailored response strategy for each individual victim.
We promptly engaged in negotiations with the victims with whom a settlement was possible. For matters in which an immediate settlement was difficult, we prepared court deposits and related materials to demonstrate that substantive efforts had been made to restore the victims’ losses. In addition, rather than merely submitting a written statement of remorse, we comprehensively organized and presented to the court the defendant’s remorse, the family’s ability to provide protection and supervision, the plan to prevent recidivism, and the defendant’s plans for future living arrangements.
In cases involving numerous victims, outcomes are not changed by abstract pleas for leniency. The evidence must show how much of the victims’ losses were actually recovered, how the defendant attempted to fulfill his or her responsibility, and what preparations were made to reduce the likelihood of recidivism. MEGA X focused on strengthening these aspects and constructed the sentencing presentation accordingly.
