Lack of Objective Proof Supporting the Allegations of Unlawful Filming and Threats

Posted 2026.08.10  ·  Practice Area: Sexual Offenses  ·  MEGA X

Case Summary

The client sought assistance from MEGA X Law Firm after being accused of serious sex offenses, including rape, forcible molestation, quasi-rape, unlawful filming (filming using a camera or other device), threats using recorded material, and unlawful confinement.
This matter involved not merely a single act, but multiple allegations of harm arising over different periods. The statutory penalties for each offense were also severe. In particular, because the allegations included rape, quasi-rape, unlawful filming, and threats using recorded material, the direction of the initial response was critically important.
In addition, the alleged victim characterized various situations that occurred during the romantic relationship as sexual offenses, with some allegations also involving filming and threats. Accordingly, rather than addressing all of the allegations collectively, it was necessary to conduct a careful review by separating the facts and evidence according to each offense and time period.

03. Legal Strategy

MEGA X formulated its defense by reviewing the alleged victim's statements separately by offense and time period and organizing objective materials that conflicted with or undermined each allegation.

In particular, MEGA X focused on the following:
▪ Organizing changes over time and internal inconsistencies in the alleged victim's statements
▪ Analyzing the actual course of the relationship between the parties through the KakaoTalk conversations
▪ Organizing the circumstances before and after the alleged acts that made it difficult to characterize them conclusively as coercive conduct
▪ With respect to the allegations of unlawful filming, organizing the circumstances indicating that the alleged victim was aware of the filming or, at a minimum, that the filming could not readily be characterized as unilateral, surreptitious filming
▪ Emphasizing the lack of objective evidence supporting the allegations of threats using recorded material and unlawful confinement
▪ Demonstrating that, in light of the level of proof required in a criminal case, the elements of each offense had not been sufficiently established

In this process, MEGA X did not limit its efforts to isolated rebuttals. Instead, it separately examined the elements of each offense and the degree of proof required, and organized a response strategy that enabled the investigative authorities to view the matter as a whole with greater objectivity.

04. Outcome
