Practice AreaCivil
OutcomePlaintiff Partially Prevailed
StageFirst Instance
01. Background
This case involved successfully defending against approximately 80% of the amount claimed in a reimbursement action in which the plaintiff partially prevailed. The key issues were whether expenses incurred to support a family member could be claimed from another person obligated to provide support, as well as the scope of expenses and allocation of liability that could be recognized.
02. Key Issues
01
Whether a right of recourse for support expenses was established
02
Scope of expenses eligible for recognition
03
Allocation of liability among the parties

03. Legal Strategy
MEGA X distinguished between the expenses asserted by the plaintiff and the share of liability that could be legally imposed on the defendant, and organized the facts and issues of the case.
After reviewing the relevant materials and the circumstances surrounding the parties’ provision of support, we submitted our position focusing on the requirements necessary for a reimbursement claim to be recognized and the principal factors the court should consider in its determination. We also explained the circumstances making it difficult to attribute the entirety of the period and amounts claimed by the plaintiff to the defendant, as well as the factors that could be considered in the defendant’s favor.
In this process, we focused not only on whether the right of recourse itself could be established, but also on distinguishing the scope of expenses that could actually be recognized from the defendant’s appropriate share of the burden.
