Korean customs seized a package of THC gummies a friend mailed me from home — I'm a tourist. Am I being charged with smuggling?

MEGA X 2026-10-14 4
I'm American, in Korea for six weeks visiting my girlfriend, who's Korean. Before I left, a friend back home said he'd mail me "a care package." Yesterday I got a call from a number that turned out to be a customs office at Incheon, and then a visit from two officers at my girlfriend's apartment. The package addressed to me contained a bag of cannabis gummies — legal where my friend lives — and they say it's "THC" and that this is "import of narcotics."
I did not ask for them. I didn't know he'd put them in. I have a message from him saying "sent you some goodies" and that's it. The officers took a statement, took photos of my passport, and told me I'll be "summoned" and that I "should not try to leave." My flight is in three weeks.
I'm now reading that Korea treats cannabis like heroin. I'm terrified. Is receiving a package I didn't order a crime? Does "THC gummies from a legal state" matter at all? Can they really stop me leaving, and what's the actual worst case here? My girlfriend is more scared than I am and is talking about me "going to prison for years."

A Answer

Receiving a package you did not order is not, by itself, a crime; importing cannabis is, and the question the customs officers and the police are now deciding is which of those two things happened. That question turns on knowledge — whether you knew or accepted the possibility that the package contained cannabis — and the message from your friend is the first piece of evidence about it. "Legal where he lives" is irrelevant to Korean law and relevant to your state of mind. The worst case is real and you should not be flippant about it; the realistic case, for a first-time recipient with a plausible account and a cooperative record, is a closed file or a fine. Whether you fly in three weeks depends on the next two.
What this is under Korean law
Cannabis is controlled under the Narcotics Control Act (마약류관리법, mayangnyu gwalli-beop). Importing it, in any form — flower, edibles, oil — is treated more seriously than possession: import or export of cannabis carries a range that begins at one year's imprisonment and runs to ten; for larger quantities, the Act on the Aggravated Punishment of Specific Crimes raises the floor. Gummies containing THC are cannabis for this purpose; the form does not matter. Your girlfriend's fear reflects the statute, not the typical outcome for a recipient in your position — but the statute is what the police are working from.
Korean law requires intent, which includes accepting the possibility (미필적 고의, milpiljeok goui). A person who asks a friend for "goodies" from a legal state, knowing what the friend uses, is in a different position from one who was surprised. The messages decide which you are.
How the process works in Korea
Customs detected the package; the case is now a police narcotics investigation. You will be summoned for a suspect interview, likely asked to give a urine or hair sample — which you may decline without a warrant, and which you should discuss with counsel first, because a positive result from use abroad complicates a case that is otherwise about a package — and asked to hand over your phone or its contents, which you may also decline without a warrant. The police then refer the case to the prosecutor (송치, songchi) or close it (불송치, bulsongchi). Recipients who did not order the contents and whose messages support that have received non-referrals or suspensions of indictment (기소유예, giso yuye); those whose messages show a request have been indicted.
Your situation as a foreign national
A departure suspension (출국정지, chulguk jeongji) is requested readily in drug cases involving foreign nationals; assume one is being requested and confirm through counsel. "Should not try to leave" is a description of that request. A suspension is lifted when the investigation no longer needs your presence — once your statement is complete and a lawyer is on record to receive documents — and for a case that closes, that can happen inside your three weeks. Boarding a flight against an active suspension is not possible; leaving before one is imposed, with the case open, converts a closable case into a suspended file with a warrant that meets you at the border next time.
You are entitled to an interpreter at the interview and to have the US consulate notified if you are detained.
A drug conviction is a ground for entry refusal and deportation review under the Immigration Act; for a tourist, the practical consequence is a future entry ban, decided by the Immigration Office. A closed case has no such effect. MEGA X handles the criminal case.
What to do now, and what not to do
Do not reply to your friend beyond "don't send anything else" — and preserve his "goodies" message exactly, along with anything earlier that shows you did not ask. Do not consume anything, and do not agree to a test on the day of the interview without advice. Do not go to the customs office or police station alone. Prepare your account with your lawyer before the interview: what you asked for, what you expected, when you learned what was in the package.
From a former police investigator's perspective
Mail-seizure cases are decided on two things: the message thread with the sender, and the recipient's history. An American who has never used, whose messages show a friend acting on his own, and whose test — if he chooses to take one — is clean, is a file the investigator closes as "recipient, no intent." The same American with a positive hair test and a thread that says "bring the usual" is a different file. Investigators know how these packages are sent; what they need is a reason to believe you did not ask for this one. Give them that reason on paper, through counsel, before they draw their own conclusion from your phone.
