Q
I was arrested. Can I be deported straight from the police station?
A Answer
Generally, no.
If you are a lawful resident, the criminal process normally runs its course first — investigation, the prosecutor's decision, and any trial. Immigration action typically follows the outcome. The exception is when there is a separate immigration violation, such as overstaying, in which case immigration may become involved earlier. Either way, request a lawyer and an interpreter immediately.
