In the investigation into the recent serial murder case at motels in Gangbuk, records of the suspect’s use of ChatGPT, a generative artificial intelligence tool, were found to have become the smoking gun proving intentional murder.

Police applied the charge of murder after discovering circumstances suggesting that the suspect, a 22-year-old woman surnamed Kim, had planned the crimes in advance using ChatGPT.

While some have raised concerns that this case shows the potential for generative AI to be misused for criminal purposes, others say it is time for broader discussions in response to the spread of AI.

However, the case entered a new phase when additional evidence, including Kim’s ChatGPT conversation records, was secured during the forensic examination of her mobile phone. According to the investigation, Kim had entered questions into ChatGPT before the crimes, such as “What happens if sleeping pills and alcohol are taken together,” “How much would be dangerous if taken together,” and “Could it lead to death?”

In particular, after the victim in the first crime regained consciousness, Kim is believed to have obtained assistance from AI and other sources and significantly increased the amount of drugs administered in subsequent crimes. Based on Kim’s ChatGPT conversation records and other evidence, police determined that she could have sufficiently foreseen the possibility of the victims’ deaths and that there was intent behind the crimes. They therefore applied murder charges instead of the initial charge of bodily injury resulting in death.

Attorney Chon Hyeong Hwan of Mega-X Law Office said in a phone interview with New Daily that day, “As not only criminals but also investigative agencies are increasingly using generative AI, the use of AI conversation records in investigations is expected to expand further going forward.”

He continued, “Although generative AI may restrict direct answers due to ethical concerns, there remains a possibility that it could be misused for crime through indirect or bypass questions.” He explained, “Investigative agencies need to strengthen their analytical capabilities to respond to crimes involving generative AI and advance investigative systems that make use of AI records.”
