SEOUL, Newsis — Several months have passed since the Supreme Court issued a ruling expanding the scope of application of the Telecommunications Fraud Damage Refund Act, but investment fraud victims are still being indicted as “false reporters.” A paradox continues in which a law created to protect victims is instead turning them into suspects.

Chon Hyeong Hwan, Managing Partner at Mega-X Law Office, said, “Crimes continue to evolve. Investment chat room scams and virtual asset scams cause high-value damages just as serious as those caused by voice phishing.”
He pointed out, “If the crimes share the same structural characteristics, it is reasonable to provide the same means of relief.”
He emphasized, “Legislative action must be taken promptly, such as revising or deleting proviso clauses that limit the scope of protection.”
