As the global push for eco-friendly and low-carbon transportation has led to the wider adoption of electric vehicles, a series of recent fires and the resulting damage have suddenly turned EVs into an “ugly duckling.”

Attorney Chon Hyeong Hwan of YK Law Firm said, “This is a case where it is quite difficult to place responsibility on one particular side. If there was a defect in the battery itself, Mercedes-Benz would bear primary responsibility. For that reason, Mercedes-Benz may later seek legal responsibility from Farasis, the Chinese battery manufacturer.”
He added, “However, with regard to the spread of the fire, the apartment complex may also bear civil liability for damages due to violations of laws related to the management of firefighting facilities.”
Attorney Chon continued, “If the case goes to court, there will likely be a dispute over the burden of proof. Since many people suffered damage from the fire, naturally, each party will argue that it bears no responsibility.”
He further explained, “In principle, the party claiming damages bears the burden of proof. However, in this case, because it is difficult to determine responsibility for the cause of the fire, it remains uncertain how far the court will assign the burden of proof and to whom.”
