According to a YTN report on May 7, Attorney Chon Hyeong Hwan of YK Law Firm said, “If the affected business can prove intent, criminal punishment is possible.”
However, he added, “In reality, when small business owners suffer no-shows, they must prove intent, but doing so is difficult.” He further explained, “Even if they manage to prove intent, many give up because the amount of damages is not very large, while litigation costs can be substantial.”
In other words, owners of small restaurants often have no choice but to bear the loss when they experience a one-time no-show without clear evidence of repeated conduct or intent.
