By Cho So-hyun, The Fact — Singer Kim Ho-joong, who faces allegations including drunk driving hit-and-run and switching drivers, is now at a crossroads over whether he will be detained. Police have moved to secure Kim’s custody after finding that his statements lacked credibility and identifying circumstances suggesting destruction of evidence. Some in the legal community believe there is a high possibility that Kim will be detained.

Attorney Chon Hyeong Hwan of YK Law Firm said, “Causing injury by dangerous driving under the Act on the Aggravated Punishment of Specific Crimes carries a heavier sentence than drunk driving under the Road Traffic Act.” He added, “The fact that police applied the charge of causing injury by dangerous driving means they are conducting a highly intensive investigation. In practice, this charge is applied when the blood alcohol concentration reaches the level for license revocation. This means police believe he had consumed a significant amount of alcohol.”

Attorney Chon analyzed that the confusion caused by Kim and officials from his agency during the investigation would also be taken into consideration. He said, “Because they disrupted the criminal justice system and infringed upon a national legal interest, there is a high possibility that he will be detained.” He added, “From the perspective of the judge handling the warrant hearing, if the warrant is dismissed, the judge may face public criticism questioning whether the law is truly functioning. Given the high level of public attention surrounding this case, it appears likely that the warrant will be issued.”
